User Agreement
Every account accepts this agreement the first time it signs in.
Version 2026-09-25 — please read this agreement fully. It is a legally binding contract between you and CartX ("CartX", "we", "us"), which operates the online marketplace at cartx.co.in (the "Platform").
1. Acceptance and electronic contract
1.1 By ticking the box and clicking "I Agree" you accept this agreement in full. Clicking "Decline" or closing the pop-up means you do not accept, and you cannot sign in or use the Platform.
1.2 This is an electronic contract. Under the Information Technology Act, 2000 and the Indian Contract Act, 1872, a contract formed by electronic means is valid and enforceable, and no physical or digital signature is needed beyond your acceptance here.
1.3 You confirm that you are 18 years or older and competent to contract under the Indian Contract Act, 1872. If you are under 18, a parent or legal guardian must use the Platform on your behalf.
1.4 Record of acceptance. When you accept, CartX records your account, the date and time, the version of this agreement, your IP address and your browser details. You agree that this electronic record is valid evidence of your acceptance and may be produced in any proceeding, as an electronic record under the Information Technology Act, 2000 and the Bharatiya Sakshya Adhiniyam, 2023 (which replaced the Indian Evidence Act, 1872). You agree not to deny having accepted this agreement.
2. Your account
2.1 You must give true, current and complete information and keep it updated. You are responsible for all activity under your account and for keeping your password and Google sign-in secure.
2.2 Do not share your account, impersonate anyone, or create accounts to get around a suspension or a rejection.
2.3 CartX may suspend or close an account that breaks this agreement or the law, or that CartX reasonably suspects of fraud or abuse.
3. Buying on the Platform
3.1 CartX is a marketplace. Products are sold by independent sellers (and, for some listings, by CartX). The contract of sale for a product is between you and the seller; CartX provides the Platform, payment facilitation and support.
3.2 Prices are shown in Indian Rupees and include or state applicable taxes (GST) at checkout. The price, discounts, delivery charges and total are shown before you place the order. Placing an order is your offer to buy; the contract is formed when the order is confirmed.
3.3 CartX or the seller may cancel an order for a clear pricing or listing error, lack of stock, suspected fraud or an address that cannot be served. If you have already paid, the full amount is refunded to the original payment method.
3.4 Product descriptions, photos, brand, category and stock are provided by sellers. Sellers must describe products truthfully, and you may rely on the listing when you buy.
3.5 Payments. Online payments (UPI, cards, netbanking, wallets) are processed by Razorpay and its banking partners. CartX does not see or store your full card or UPI credentials. Cash on delivery is available where shown. You agree that payment obligations are binding once an order is confirmed.
3.6 Delivery. Delivery dates are estimates. You must give a correct and reachable address and phone number. Risk in the product passes to you on delivery. Please check the package on delivery and report visible damage promptly.
3.7 You must not buy for resale of restricted items, misuse coupons or offers, place fake or repeated orders you do not intend to keep, or abuse the returns process. CartX may cancel such orders and recover the benefit.
4. Cancellation, returns and refunds
4.1 Before dispatch you may cancel an order from the order page. A prepaid order is refunded in full.
4.2 Return window. Unless a listing states a different or longer period, you may request a return within 7 days of delivery from the order page. A return request is reviewed and must be approved before a refund is made.
4.3 Condition of returned items. Returned items must be unused, in original packaging, with tags, accessories and invoice, except where the item is defective, damaged or not as described (see clause 5). Items that are perishable, made to order, personalised, hygiene-sensitive (for example innerwear or opened cosmetics), digital, or marked "non-returnable" on the listing may not be eligible for return unless defective or wrongly supplied.
4.4 Refunds. An approved refund is issued to the original payment method. For cash on delivery orders it is issued by bank/UPI transfer to details you provide. Refunds are normally initiated within 7 working days of approval; your bank or wallet may need additional time to show the credit. Delivery charges are refunded when the return is due to a defect, damage or wrong item.
4.5 CartX or the seller may refuse a return that is outside the window, fails the conditions above, or shows signs of misuse, and will give the reason. Nothing in this clause limits your statutory consumer rights.
5. Defective, damaged, wrong or not-as-described products
5.1 A product is "defective" if it has a fault, imperfection or shortcoming in quality, quantity, potency, purity or standard that is required by law or that the seller claimed, and includes products that are damaged in transit, the wrong item, incomplete, expired, counterfeit or materially different from the listing.
5.2 If you receive such a product, report it through the order page within 7 days of delivery (or within the warranty/guarantee period stated on the listing, if longer), with photos or a short video of the product, the packaging and the shipping label. Keep the product and packaging until the claim is resolved.
5.3 For a genuine defect you are entitled, at your choice where the product allows, to a replacement, repair, or a full refund including delivery charges, without the "unused" condition in clause 4.3. Sellers may not refuse a return or refund where goods are defective, deficient, not as described, or delivered late (other than for reasons outside the seller's control), as required by the Consumer Protection (E-Commerce) Rules, 2020.
5.4 Under the Sale of Goods Act, 1930, goods sold must match their description, be of satisfactory quality and be fit for the purpose for which they are sold, and the seller must have the right to sell them. The Consumer Protection Act, 2019 gives consumers remedies for defective goods, deficiency in service, unfair trade practices and unfair contracts, including product liability of the manufacturer, seller and service provider for harm caused by a defective product.
5.5 Where a claim is not resolved to your satisfaction you may use the grievance process in clause 10 and, independently, approach the District Consumer Disputes Redressal Commission or the National Consumer Helpline (1915). This agreement does not waive any right you have under the Consumer Protection Act, 2019.
6. Selling on the Platform
6.1 Becoming a seller. A seller account is created only after you apply with a Google account, provide true shop details, PAN and GST number, upload a matching PAN card image, and CartX approves the application. CartX may verify these details, may reject or revoke a seller account at any time, and does so in its discretion and as required by law.
6.2 Truthful listings. Every listing you submit (name, brand, category, price, discount, stock, photos, description) must be accurate, lawful and not misleading. Each listing is reviewed by CartX before it goes live, and CartX may reject or remove it. You must display the details the law requires, such as the maximum retail price, net quantity, manufacturer or importer details, and country of origin, in line with the Legal Metrology Act, 2009 and the rules made under it.
6.3 Genuine goods and rights. You must have the right to sell what you list, sell only genuine, non-infringing goods and not sell counterfeit, stolen, expired, unsafe or prohibited items (including anything illegal under Indian law, weapons, drugs, adult content, or wildlife products). You must not infringe any trade mark, copyright or other intellectual-property right (Trade Marks Act, 1999; Copyright Act, 1957) and you confirm you own or are licensed to use the photos and text you upload.
6.4 Taxes and invoices. You are responsible for your own GST registration, tax collection, invoices and filings under the Central Goods and Services Tax Act, 2017 and other applicable laws, and for any other licences your goods require. CartX is not your tax advisor.
6.5 Fulfilment. You must keep stock accurate, dispatch confirmed orders promptly, pack safely, and honour the delivery, return, refund, replacement and warranty terms in this agreement and the law. Where a return or refund is approved, you agree that the amount may be deducted from your earnings or recovered from you.
6.6 Your dashboard and earnings. Sales figures shown in your seller dashboard are reports of gross sales. Any fee, commission, payout schedule or deduction that CartX introduces will be notified to you in advance and applies to sales after the notice.
6.7 Responsibility. As the seller you are responsible to the buyer for the product, its description and its quality. You agree to indemnify CartX against claims, losses and penalties arising from your listings, your goods, your breach of law or this agreement, or your infringement of anyone's rights.
6.8 Reviewers and admins. CartX staff (Watchers and Admins) may inspect, reject or remove any seller submission or listing. A rejection includes a reason; you may correct the submission and submit it again.
7. Conduct, content and prohibited use
7.1 You must not use the Platform for anything unlawful, to harm or harass others, to post false reviews, to upload malware, to scrape or overload the service, to bypass security or approvals, or to reverse-engineer it.
7.2 Reviews and other content you post must be honest and lawful. You give CartX a non-exclusive, royalty-free licence to display it on the Platform.
8. Privacy and personal data
8.1 By accepting this agreement you consent to CartX collecting and processing your personal data (name, email, phone, delivery address, order and payment status, and for sellers PAN, GST and shop details) to run your account, fulfil orders, prevent fraud, meet legal obligations and provide support, as described in our Privacy Policy and as permitted by the Digital Personal Data Protection Act, 2023 and the Information Technology Act, 2000.
8.2 Delivery details are shared with the seller and courier of your order; payment data is handled by Razorpay. You may ask to access, correct or delete your data, or withdraw consent, by writing to the contact in clause 10 (some records must be kept by law).
9. Liability, indemnity and changes
9.1 To the extent the law permits, CartX is not liable for indirect or consequential loss, for a seller's or courier's acts, or for interruptions of the Platform outside its reasonable control. Nothing in this agreement excludes liability that cannot be excluded by law, or limits your rights as a consumer.
9.2 You agree to indemnify CartX against claims and losses caused by your breach of this agreement or of the law.
9.3 We may update this agreement. When we do, the version changes and you will be asked to accept the new version before you continue. If any part is found unenforceable, the rest remains in force.
10. Grievances, governing law and disputes
10.1 Grievance officer. Write to www.atomworks@gmail.com with your account email and order number. CartX will acknowledge a complaint within 48 hours and aim to resolve it within one month, as required by the Consumer Protection (E-Commerce) Rules, 2020.
10.2 Governing law. This agreement is governed by the laws of India. Subject to your statutory right to approach a Consumer Commission where you live or work, the courts having jurisdiction at CartX's registered office have jurisdiction over any dispute, after you have first tried to settle it through the grievance process above.
